Readers will recall from an article Holman Webb published back in 2018 that the Australian Cybersecurity Centre recommended eight best-practice mitigation strategies (the 'Essential Eight') that organisations should implement as a baseline defence against targeted cyber intrusions, ransomware and malicious insiders.

These strategies may seem relatively straightforward to those working within the IT industry, but the failure of organisations to implement the strategies (including government instrumentalities) has moved the Australian government to consider mandating the implementation of the Essential Eight controls, and requiring all public service entities to implement them forthwith.

Holman Webb is pleased to announce that Partner and Insurance Group National Team Leader John Van de Poll has been listed as a finalist in the Lawyers Weekly Partner of the Year Awards 2021 - Insurance Partner of the Year category!

This finalist position follows John's Insurance Partner of the Year wins in both 2016 and 2019.

Recent examples of the damage or destruction of culturally significant Aboriginal sites and artefacts has led to a debate about the most appropriate legal tools for their protection. One recent success story wherein a creation 'story site' on Prince of Wales Island (Muralug) in the Torres Strait was protected from a safe harbour development, demonstrates that the courts are willing to step in and grant urgent protection.

The Full Court of the Federal Court recently delivered its judgment in the matter of Badenoch Integrated Logging Pty Ltd v Bryant, in the matter of Gunns Limited (in liq) (receivers and managers appointed) [2021] FCAFC 64.

The decision will undoubtedly have significant implications for the ongoing application of the peak indebtedness rule by creditors and liquidators.
