According to SafeWork Australia, there were 1,222 COVID-19 related workers’ compensation claims in 2020. Employers must now navigate claims for work-related COVID-19 transmission, as well as having to navigate workplace discrimination laws and human rights issues when seeking to keep their employees safe.

Presented by Holman Webb Workplace Relations Partner Alicia Mataere, Senior Claims Adjuster at Berkley Insurance Australia Andrew Clark, and Workplace Review and Investigations Expert Scott Fanker, this seminar will cover:

  • General trends in the employment space;
  • How unfair dismissal and general protection claims differ;
  • Addressing workplace complaints and the impact of COVID on managing investigations; and
  • How the Fair Work Commission/Federal Court is approaching claims around vaccine/mask mandates.

About the Presenter/s

Alicia Mataere

Alicia is a workplace relations and safety law specialist, having worked exclusively in the area since 2004.  She has advised and developed strategies for clients across various industries, including government and private sectors, publicly listed companies, Affiliated Health Organisations, religious and not-for-profit organisations.  

Alicia is also an experienced advocate, having advised and advocated in the first Equal Pay Case under the Fair Work Act 2009 (Cth), as well as other dismissal disputes before both the Fair Work Commission and Federal Circuit Court of Australia.

Andrew Clark

Andrew Clark is a senior Insurance professional responsible for a diverse portfolio of claims with a particular focus on Professional Indemnity, Directors & Officers and Employment Practices Liability.  He has been recognised in Insurance Business Magazine’s 2019 Young Guns Award and has significant experience managing client’s employment related disputes. 

Scott Fanker

Scott is a Workplace Review and Investigations consultant and has a background of working in clinical, academic, and senior management and leadership positions in public sector mental health services. More recently, Scott worked in NSW Ministry of Health roles in which he assessed, managed, and investigated complex and sensitive complaints and misconduct matters across the health system. His expert witness experience extends to numerous  matters involving employee risk assessment and mitigation.
